Terms of Use

In one breath
These Terms of Use govern your access to and use of the Pewpad application and the website at getpewpad.com. They describe your rights, your obligations, the licences granted to you, the warranties disclaimed, and the law and venue that apply. Please read them carefully before using the Service. By installing, accessing, or using Pewpad, you accept these Terms in full.

1. Definitions

How these Terms refer to Pewpad, the Service, you, and the content involved.

For the purposes of these Terms of Use (the “Terms”):

  • “Pewpad”, “we”, “us”, or “our” means the operator of the Service (Olanrewaju, doing business as Pewpad, with notice address provided in Section 30).
  • “Application” means the Pewpad software application distributed through the Apple App Store and TestFlight for use on iPhone, iPad, Mac, and other Apple devices, including all updates, upgrades, modifications, and accompanying components.
  • “Service” means the Application together with the website located at getpewpad.com and any related services made available by Pewpad.
  • “User”, “you”, or “your” means the individual accessing or using the Service.
  • “Content” means any text, sermon notes, outlines, scripture references, illustrations, audio, voice profile data, transcripts, tags, series, church records, delivery records, and any other materials created, uploaded, imported, or otherwise made available by you through the Service.
  • “Beta Features” means features identified as beta, preview, experimental, or made available through Apple TestFlight or any other pre-release distribution channel.
  • “Apple” means Apple Inc. and its subsidiaries.

2. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Pewpad. By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

Continued use of the Service following the publication of revised Terms constitutes acceptance of those revisions.

3. Eligibility

You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, to use the Service. If you are accessing the Service on behalf of an organization, ministry, or church, you represent and warrant that you have the authority to bind that entity to these Terms, in which case “you” refers to that entity.

You may not use the Service if you are barred from doing so under the laws of any jurisdiction applicable to you, or if you have been previously suspended or removed by Pewpad.

4. License Grant

A limited, personal, revocable license to use the Application for its intended purpose.

Subject to your continuous compliance with these Terms, Pewpad grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Application on any Apple-branded device that you own or control, solely for your personal, non-commercial sermon preparation, study, and ministry use, and solely as permitted by the Apple Media Services Terms and Conditions and the Apple Licensed Application End User License Agreement.

All rights not expressly granted to you in these Terms are reserved by Pewpad and its licensors.

5. License Restrictions

You agree that you shall not, and shall not permit any third party to:

  • copy, modify, or create derivative works based on the Application;
  • reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying ideas, algorithms, structure, or organization of the Application, except to the extent applicable law expressly permits such activity notwithstanding this limitation;
  • distribute, sublicense, lease, lend, sell, rent, or otherwise transfer rights to the Application;
  • remove, alter, or obscure any proprietary notice (including any copyright or trademark notice) on or in the Application;
  • use the Service to develop, train, or improve any competing product or service, including any large language model, speech model, or generative system;
  • use the Application in a way that violates these Terms, applicable law, or any third-party rights;
  • circumvent or attempt to circumvent any technical measure designed to limit, restrict, or protect the Application;
  • interfere with, disrupt, or impose an unreasonable load on the Service.

6. User Content and Ownership

You retain all ownership of the Content you create. We claim no rights over your sermons.

As between you and Pewpad, you retain all right, title, and interest, including all intellectual property rights, in and to your Content. Pewpad does not claim ownership of any Content you create, import, or store using the Service.

Because Content is processed and stored on your device (and optionally synchronised through your private iCloud account), Pewpad does not require, and does not request, a content license for the operation of the Service. Where any incidental processing is technically necessary to provide a feature you have invoked (such as on-device indexing), that processing is performed ephemerally and only on your device, in accordance with the Privacy Policy.

You represent and warrant that: (i) you own or have the necessary rights, licenses, consents, and permissions to use any Content you import, paste, or upload into the Application; and (ii) the Content does not and will not infringe, misappropriate, or violate a third party’s rights, including copyright, trademark, publicity, privacy, or other proprietary or intellectual property rights.

7. Acceptable Use

You agree not to use the Service to:

  • engage in or encourage any unlawful, harmful, fraudulent, infringing, defamatory, threatening, harassing, hateful, or obscene activity;
  • transmit any virus, worm, trojan horse, malware, or other code of a destructive or disruptive nature;
  • attempt to gain unauthorised access to any portion of the Service, related systems, or networks;
  • collect or harvest any personally identifiable information from other users without authorization;
  • impersonate any person or entity, or misrepresent your affiliation with a person or entity;
  • use the Service to generate, store, or distribute material that sexually exploits or abuses children, or material that facilitates self-harm or violence.

8. Bible, Commentary, and Third-Party Resources

Resources provided by third parties remain subject to their own licences.

The Application may include, link to, or enable the download of Bible translations, commentaries, dictionaries, lexicons, theological resources, and on-device machine-learning models (collectively, “Third-Party Resources”). Such Third-Party Resources are made available for your convenience and remain the intellectual property of their respective rights holders.

Your use of any Third-Party Resource is subject to the licence, terms, and any usage restrictions imposed by the applicable rights holder. You are solely responsible for ensuring your use complies with those terms, including any restrictions on copying, public performance, redistribution, or commercial use.

Pewpad makes no representations or warranties regarding the accuracy, completeness, doctrinal orthodoxy, or fitness of any Third-Party Resource for any particular purpose.

9. Artificial Intelligence and Generative Features

AI-assisted output is informational only and may be inaccurate; you must verify before reliance.

The Application includes features that use on-device artificial intelligence and machine-learning models to generate, summarise, extract, suggest, or transform Content (collectively, “AI Output”), including but not limited to entity extraction, similarity suggestions, sermon recap generation, devotional drafting, and small-group guide generation.

AI Output is generated programmatically and may be inaccurate, incomplete, biased, outdated, fabricated, or otherwise unreliable. AI Output is provided for informational purposes only and does not constitute the work, position, theological view, or endorsement of Pewpad. You must independently review, evaluate, and verify any AI Output before relying upon it, citing it, reproducing it, or making it public.

You are solely responsible for any decision to use, edit, publish, preach, or distribute AI Output, and for any consequences arising therefrom. Pewpad disclaims all liability arising from your reliance on AI Output to the maximum extent permitted by law.

10. Voice and Speech Recognition Features

The Application includes voice-assisted features such as scripture reference detection, transcript capture during delivery, and calibration of a local voice profile. These features rely on on-device speech recognition technologies provided by the operating system and may be affected by microphone quality, ambient noise, accent, pronunciation, language model coverage, device orientation, system permissions, and operating-system availability.

Voice features are provided on an “as available” basis. You should verify any reference activation, transcript output, or system response before relying upon it during sermon delivery or any other consequential use.

11. No Professional or Pastoral Advice

The Service is provided as a productivity, study, and reference tool. Nothing made available through the Service constitutes legal, financial, medical, theological, doctrinal, pastoral, counselling, or other professional advice. You are solely responsible for the theological content, doctrinal accuracy, citations, and pastoral application of any sermon, communication, or material you produce using the Service.

12. Beta and TestFlight Features

Pre-release builds may change, fail, or be discontinued without notice. Maintain your own backups.

Beta Features are made available for evaluation purposes and may contain bugs, errors, or other issues. Beta Features may be modified, suspended, or discontinued at any time, with or without notice, and may operate differently from generally released features. Data created or processed within Beta Features may be lost, corrupted, or rendered inaccessible without notice.

You are responsible for maintaining independent backups of any Content of value to you. To the maximum extent permitted by law, Pewpad shall have no liability for any loss arising from the use of Beta Features.

13. Intellectual Property of Pewpad

All rights, title, and interest in and to the Application, the Service, and all related materials — including without limitation the source code, object code, designs, illustrations, icons, audio, animations, user-interface elements, structure, organization, and documentation — are and shall remain the exclusive property of Pewpad and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

14. Trademarks

“Pewpad”, the Pewpad notebook mark, and related marks, slogans, and trade dress (the “Pewpad Marks”) are the trademarks of Pewpad. You may not use the Pewpad Marks without our prior written permission, except for limited descriptive reference where such use is fair and lawful. All other trademarks referenced on the Service are the property of their respective owners.

15. Feedback

If you choose to provide ideas, suggestions, comments, bug reports, or other feedback regarding the Service (“Feedback”), you grant Pewpad a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, transferable licence to use, reproduce, modify, prepare derivative works of, publish, distribute, and otherwise exploit such Feedback for any purpose without compensation or attribution. You represent that any Feedback you provide is original to you or that you have the right to grant this licence.

16. Apple-Specific Terms

Provisions required by Apple where Pewpad is delivered through the Apple App Store.

The following provisions apply to your use of the Application as obtained through the Apple App Store:

  • Acknowledgement. These Terms are concluded between you and Pewpad only, and not with Apple. Pewpad, not Apple, is solely responsible for the Application and its content.
  • Scope of Licence. The licence granted to you for the Application is limited to a non-transferable licence to use the Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
  • Maintenance and Support. Pewpad is solely responsible for providing any maintenance and support services with respect to the Application. Apple has no obligation to furnish any maintenance or support services.
  • Warranty. Pewpad is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
  • Product Claims. Pewpad, not Apple, is responsible for addressing any claims relating to the Application or your possession or use of the Application, including product liability, conformity, intellectual-property infringement, and consumer-protection claims.
  • Intellectual Property Rights.In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party’s intellectual-property rights, Pewpad, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such infringement claim.
  • Legal Compliance.You represent and warrant that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties.
  • Third-Party Beneficiary.Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Pricing, Subscriptions, and Payments

The Application is currently distributed through Apple TestFlight at no charge. Pewpad reserves the right to introduce paid features, in-app purchases, or subscription tiers at any time. Any such offerings will be billed and managed through your Apple ID by Apple in accordance with Apple’s then-current Media Services Terms and Conditions.

Refund eligibility, billing inquiries, and cancellation rights for App Store purchases are administered by Apple. Pewpad is not able to issue refunds for transactions processed by Apple.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, THE APPLICATION, AND ALL CONTENT, OUTPUT, AND THIRD-PARTY RESOURCES MADE AVAILABLE THROUGH THEM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. PEWPAD SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

PEWPAD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT, INCLUDING AI OUTPUT, WILL BE ACCURATE, RELIABLE, OR FIT FOR ANY PARTICULAR PURPOSE.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PEWPAD, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, EVEN IF PEWPAD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL PEWPAD’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT, IF ANY, PAID BY YOU TO PEWPAD FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

The limitations of this Section apply to all claims, regardless of their basis, including contract, warranty, tort (including negligence), strict liability, statute, or otherwise. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the foregoing exclusions and limitations may not apply to you in full.

21. Indemnification

You agree to defend, indemnify, and hold harmless Pewpad and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; (d) any claim that any Content you submitted caused damage to a third party; or (e) your violation of applicable law.

22. Term and Termination

These Terms will remain in effect until terminated by you or by Pewpad. You may terminate these Terms at any time by ceasing all use of the Service and uninstalling the Application from your devices. Pewpad may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, including violation of these Terms, with or without notice and without liability to you.

Upon termination, all licences granted to you under these Terms will immediately cease. Sections that by their nature should survive termination shall survive, including without limitation Sections 6 (User Content and Ownership), 13 (Intellectual Property), 19 (Disclaimer of Warranties), 20 (Limitation of Liability), 21 (Indemnification), and 26 (Governing Law).

23. Modifications to the Service

Pewpad reserves the right at any time to modify, suspend, or discontinue, temporarily or permanently, all or any portion of the Service, with or without notice. Pewpad shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

24. Changes to These Terms

Pewpad may revise these Terms from time to time. The most current version will always be posted on this page with a revised “Last updated” date. Material changes will be communicated through the Service or by other reasonable means where required by law. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those revisions.

25. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms. Where you are a consumer, you may also be entitled to the protections of mandatory consumer-protection laws of your country of residence.

26. Dispute Resolution and Venue

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be addressed through good- faith negotiation between the parties. If the parties cannot resolve the matter within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of Lagos State, Nigeria, except that Pewpad may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual-property rights.

27. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including the U.S. Export Administration Regulations and all sanctions administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control. You represent that you are not located in, under the control of, or a national or resident of any country embargoed by the United States or listed on any U.S. government list of prohibited or restricted parties.

28. Severability and Waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if such modification is not possible, severed, and the remaining provisions shall continue in full force and effect. No failure or delay by Pewpad in exercising any right under these Terms constitutes a waiver of that right.

29. Entire Agreement; Assignment

These Terms, together with the Privacy Policy and any other legal notices published by Pewpad on the Service, constitute the entire agreement between you and Pewpad concerning the Service and supersede all prior or contemporaneous communications and proposals. You may not assign or transfer these Terms, by operation of law or otherwise, without Pewpad’s prior written consent. Any attempted assignment in violation of this Section shall be null and void. Pewpad may assign these Terms, in whole or in part, without restriction.

30. Force Majeure

Pewpad shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including without limitation acts of God, natural disasters, power outages, internet or telecommunications failures, government actions, labour disputes, or other circumstances of force majeure.
